WHAT HAS CHANGED WITH THE NEW MINING LAW? – BARAN UMUT BAYCAN
The Mining Law, which has appeared in the agenda with the recent negative developments, became subject to amendments at the General Board Meeting of the Grand National Assembly, following the repeal of some of it’s provisions by the Constitutional Court. Through the amendments although certain transfers of authorization was envisaged between some administrative authorities, and certain pending issues were clarified, the Systematic of the Turkish Mining Legislation has remained intact.

When considering the penalties that are imposed in the form monetary fines or imprisonment to those who violate the Turkish tax laws, the national law treats these violations as criminal offenses and they are arranged to be deterrent. As such the legal system must ensure legal protections and individuals are entitled to rihgt to a fair trial during these legal proceedings and any legal action undertaken in relation to tax law implementation.
A LEGAL OVERWIEV TO THE MINING INDUSTRY – BARAN UMUT BAYCAN
Turkey has recently amended its mining regulations for attracting more domestic and foreign private investors in the industry. Some environmental groups criticized this amendment regarding the elimination of the environmental controls substantially and some domestic mining investors critized it for being radically open to foreign investors.
